EULA - End User License Agreement

PLEASE READ THE FOLLOWING NETUPDATER (TkmNetUpdate) END-USER LICENSE AGREEMENT CAREFULLY.THIS LICENSE AGREEMENT IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR A SINGLE ENTITY) AND KIDMOSES.COM OR ANY SUBSIDIARY, AND ITS SUPPLIERS. BY INSTALLING OR USING THIS DELPHI COMPONENT IN ANY WAY YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THIS COMPONENT IN ANY WAY.RIGHTS:A non-exclusive and non-transferable license to use the shareware version of NetUpdater (software) component for evaluation purposes only. The trial versions of this component is fully functional, but pops up a trial notice whenever the application it is installed to is launched. (This limitations do not apply if you have registered the component.)One registered copy of NetUpdater may either be used by a single developer (person or company) to provide software updates to an unlimited number of applications written by the developer. Registered owners will receive the source code, which may be modified for personal use.To distribute the component in its original shareware form to third parties, provided that these parties accept the terms of this Agreement.IT IS STRICTLY PROHIBITED TO:Modify the software product in whole or in part and resell it as your own.Reverse engineer, decompile, or disassemble the software, or otherwise attempt to discover the source code of unregistered version. (Registered users are provided the source code.)For registered users, it is strictly prohibited to give your registered copy or source code to third parties.SHOULD YOU FAIL TO COMPLY WITH ANY OF THE CLAUSES ABOVE, YOUR USER RIGHTS ARE AUTOMATICALLY TERMINATED. THIS TERMINATION IS IN ADDITION TO THE LEGAL, CIVIL OR OTHER REMEDIES THAT KIDMOSES.COM OR ANY SUBSIDIARY, AND ITS SUPPLIERS, MAY SEEK.LIMITED WARRANTY:DISCLAIMER FOR INDIRECT DAMAGES. This Delphi Component is provided and licensed "as is", without any warranty of any type, either express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. In no event shall Kidmoses.com, subsidiaries, creators, developers, or any other third parties involved in the creation, production, or delivery of the softare be liable for any type of damage, in any circumstance (including, but not limited to, the direct or indirect damages caused by loss of business profits, business interruption, loss of business or personal information, or any other pecuniary loss), arising out of the use of or the inability to use the software product, even if Kidmoses.com or any subsidiary, and its suppliers, has been advised of the possibility of such damages.The user is entirely responsible for the results or performance of this software product. Kidmoses.com may terminate this license at any time by informing the software product user. The user may terminate the End-User license by either destroying or erasing all copies of the software product.This limited warranty is governed by and interpreted according to Canadian law.PROPERTY:This software is licensed and not sold. The software product, including its code, documentation, appearance, structure and design, is an exclusive product of Kidmoses.com or any subsidiary, who permanently preserves all property rights to the software product or its copies, modifications, or merged parts.
